DPDPA 2023: The End of Cookie-Driven Data Capture and the Rise of Data Principal Rights

The Digital Personal Data Protection Act 2023 (DPDPA) has significantly transformed the dynamics of how digital asset owners collect, access, and utilize personal data. For years, organizations have relied on various digital tracking and data deviation techniques to gain extensive access to user data and behavioral insights.

With the introduction of DPDPA compliance requirements, the traditional reliance on Terms & Conditions (T&C) acceptance and cookie-based data collection mechanisms is gradually becoming insufficient in the evolving data privacy and data governance ecosystem.

The new regulatory framework emphasizes informed consent, transparency in data usage, and accountability of Data Fiduciaries. As a result, organizations will be required to redesign their consent architecture, data governance models, and digital data collection practices.

These regulatory prerequisites will impact almost every sector, but the most significant disruption is expected in digital marketing, social media platforms, advertising technology (AdTech), and data analytics ecosystems, where user behavior and personal data have traditionally been heavily monetized.

In many cases, Data Fiduciaries leverage the limited awareness of Data Principals regarding how their personal data is collected, processed, and monetized. By analyzing user adoption patterns, behavioral insights, and digital engagement metrics, organizations generate substantial revenue from personal data ecosystems, while Data Principals often remain unaware of the economic value generated from their own data.

As the DPDPA regulatory framework evolves, it may become necessary for policymakers and regulators to consider further amendments that strengthen Data Principal rights, potentially including discussions around fair value sharing or economic participation in the revenue generated from personal data usage.

The shift introduced by DPDPA 2023 marks the beginning of a new era where data accountability, transparency, and digital rights of individuals will play a central role in shaping India’s data-driven economy.
